Isn't this a problem with copyright?

Copyright only protects the expression of an idea. Fan films exist in a shadowy nether region and they probably exist mostly because of goodwill from copyright holders. But to be on sound legal footing to stop a fan film production you probably have to base your arguments on trademark usage. I'm not sure any of the characters are trademarked. I'm not that well-versed with HP legal issues.

The production company behind this film, Broad Strokes, also produced 2013's "The Greater Good", which was the fan film about young Dumbledore and Grindelwald.
